VAPE'S 1K GIVEAWAY

By entering into the 1K Giveaway ("Promotion"), all entrants agree to the terms and conditions listed below. The 1K Giveaway is conducted by the following LLCs: The Vaper Outlet, LLC; Red Brick, LLC; Vapor, LLC; Vape Strong, LLC; Cinder Grey, LLC; Vape Zone, LLC ("VAPE" or "Host").

1. DURATION OF THE PROMOTION & AWARD DATE

2.1 DURATION. The Promotion will run from 1 December 2025 to 31 December 2025 (inclusive) (the "Promotion Period") at all 27 locations owned and operated by VAPE. The Promotion ends at 10:00PM PST on 31 December 2025. All entries received after that time will be void.

2.2 AWARD DATE. The Award Date is defined as the last day VAPE will allocate the 1,000 AppCard points to the winner's AppCard Rewards account ("Rewards Account"). This date is 7 January 2026 (23:59 PST). The winner will be contacted and will receive confirmation the Awarded Prize has been added to their Rewards Account on or before the Award Date.

2. ENTRANTS & ELIGIBILITY

Each entrant must be aged 21 or over. Any entries obtained by a person under the age of 21 will be void. All entrants must be separate individuals. Entrants with shared phone numbers and/or rewards accounts will be awarded entries solely for the main account holder.

The following are not eligible to participate in the Promotion: (a) all persons under the legal age of 21; (b) companies, corporations, organizations, or other conglomerates and similar groups; (c) any person who obtains an entry through means of another person.

3. PRIZES

3.1 DEFINITION OF TERMS. "Prize" and "Awarded Prize" used in this document to define the 1,000 AppCard Rewards Points that will be added to the winner's account. "ARV" is defined as the approximate retail value.

3.2 PRIZE. The Host will provide the winner with 1,000 AppCard Rewards Points (ARV 100.00 USD).

3.3 AWARDED PRIZE. The winner will be contacted before or no later than the Award Date to notify them that they have won the Promotion. The Host will attempt contact three (3) times via phone call over the course of two (2) business days; an attempt will be made each time to leave a voicemail with a callback number. Host is not liable if a voicemail cannot be left; if winner does not answer or return VAPE's phone call within 24 hours after the third phone call is placed, that winner(s) will forfeit their prize. Once VAPE is able to reach the winner, VAPE will allocate the Awarded Prize to that winner. Winner will receive confirmation, whether verbal, written, or electronic, that their Awarded Prize has been added to their Rewards Account; this confirmation may be given during the initial contact, or at a later time.

4. HOW TO ENTER

Each entrant is eligible for one (1) free entry ("No Purchase Entry") during the month of December 2025. This promotion is not subject to additional entries beyond Mail-In Entries (Section 4.1) and Donation Entries (Section 4.2).

4.1 NO PURCHASE ENTRY. A No Purchase Entry will be automatically applied to an entrant's AppCard Rewards account with VAPE if an entrant uses their Rewards Account at one of VAPE's locations during the Promotion Period. If an entrant does not wish to enter via the AppCard Rewards process, they may submit a written request ("Mail-In", "Mail-In Entry", or "Mail-In Entries") for entry. The written request must abide by the following:

a. All Mail-In Entry requests must be hand-written in clear, block lettering on a piece of plain, white printer paper, OR on a piece of college-ruled lined paper.

b. All Mail-In Entry requests must contain: (a) the date of the request; (b) the first and last name of the entrant as it appears on their valid government-issued identification document; (c) the title of the Promotion; (d) the statement, "I would like to request my No Purchase Entry"; (e) a valid, working phone number to be used only by an associate in the employ of VAPE given the entrant is chosen as a winner; and be formatted as the following:

d. All Mail-In Entries must be stamped with the appropriate postage. The Host is not responsible for any Mail-Ins returned to sender by the agency conducting the transport of the Mail-In. Any Mail-Ins received without the appropriate postage will be void.

e. All Mail-In Entries postmarked after 31 December 2025 OR received after 1 January 2026 will be void. Mail-Ins received after a free entry has been associated via a Rewards Account will be void.

f. Only one Mail-In per person will be granted. Any additional Mail-Ins received by the Host for the same person will be void.

g. Mail-In entrants are required to meet the same requirements as all other entrants as described in Section 2 of this document.

4.2 DONATION ENTRIES. Donation entries may be obtained without regard to a No Purchase Entry. However, if a No Purchase Entry has been granted to an entrant during the Promotion Period, any initial donation or additional donations will not grant the entrant additional entries. Entrants will qualify for donation entries only when a Mail-In is received within the appropriate timeframe or a purchase is linked to a Rewards Account as follows:

a. 1 December 2025 - 31 December 2025 (inclusive). One (1) entry for donation to VAPE's 2025 Food Drive.

5. RELEASE OF LIABILITY

BY ENTERING THIS PROMOTION, ALL ENTRANTS AGREE TO RELEASE VAPE, ITS MEMBERS, REPRESENTATIVES, AGENTS OR OTHERWISE AFFILIATED PERSONS FROM ANY AND ALL LIABILITY FOR ACTUAL OR PERCEIVED INJURY, LOSS, OR DAMAGE, PHYSICAL OR OTHERWISE, INCLUDING BUT NOT LIMITED TO MONETARY FEES OR PAYMENTS NECESSARY TO RESOLVE AN ISSUE ARISING FROM OR CAUSED BY THE POSSESSION, USE, MISUSE OR MISUNDERSTANDING OF ANY PRIZE OR PARTICIPATION IN THE PROMOTION. EACH ENTRANT AGREES TO HOLD VAPE HARMLESS FROM ANY AND ALL ACTUAL OR PERCEIVED LOSSES, DAMAGES, LEGAL PROCEEDINGS, AND ACTIONS OF ANY KIND ARISING FROM, CAUSED BY, OR IN CONNECTION WITH THE PROMOTION. EACH ENTRANT ACCEPTS SOLE RESPONSIBLITY, LEGAL AND OTHERWISE, AND AGREES THE HOST WILL NOT BE HELD LIABLE FOR ANY ACTUAL OR PERCEIVED DAMAGE DONE TO PERSONS OR PROPERTY, PHYSICAL OR OTHERWISE. EACH WINNER AGREES TO ALLOW FOR THE TIME REQUIRED FOR PROCUREMENT OF THE AWARDED PRIZE AND AGREES TO ABIDE BY THE TIME CONSTRAINT PLACED ON PICK UP OF THEIR AWARDED PRIZE. WINNERS AGREE THAT VAPE WILL NOT BE HELD LIABLE FOR ANY ACTUAL OR PERCEIVED DAMAGE DONE DURING TRANSIT OR NON-AVAILABILITY OF THE AWARDED PRIZE; WINNERS AGREE TO DISCUSS, IN AN AMICABLE WAY AND WITHOUT LEGAL INTERVENTION, THE NON-AVAILABILITY OF AN AWARDED PRIZE AND POTENTIAL SOLUTION(S) WITH AN ASSOCIATE IN THE EMPLOY OF VAPE, AS NECESSARY. ALL ENTRANTS AND WINNERS AGREE TO FORWARD ANY AND ALL COMMUNICATIONS REGARDING THIS PROMOTION AND RELEASE OF LIABILITY VIA MAIL, APPROPRIATELY POSTMARKED, TO THE ADDRESS LISTED IN SECTION 4.1.c.
